MYTONA Contest and Advertising Campaign Rules
1.1. The Organizer of the contest and advertising campaign (hereinafter referred to as the “Contest”) is MYTONA.
1.2. Contests are not a lottery and do not require any purchases.
1.3. Contests are held via contest posts in the official communities of MYTONA’s projects on social media platforms.
1.4. The Contests held by the Organizer are not sponsored by, managed by, supported by, administered by, or connected in any way with Facebook, Twitter, YouTube, Instagram, Discord, Reddit, Weibo, Naver, VK, TikTok, Douyin (抖音) (hereinafter referred to as the “Platforms”) or any other third party. You provide all information and data to the Organizer and not to the Platforms. Each entrant completely releases the Platforms from any liability.
1.5. By taking part in a Contest, the entrant agrees to:
MYTONA’s contest rules (hereinafter referred to as the “Rules”);
Contest participation terms published for each individual Contest in MYTONA’s contest posts (hereinafter referred to as the “Contest Conditions”);

Terms and conditions of the Platforms.
1.6. All Contests are open to individuals in any country who are aged 16 or older. If you are under the age of 16, you must not participate in any Contest. If you are aged between 16 and 18 (or between 16 and the age of legal majority in your country of residence) or you otherwise do not have the authority to enter into agreements such as this, your parent or legal guardian must review and agree to the documents specified in Paragraph 1.5 of the Rules (both for themselves and on your behalf) before you can take part in Contests.
1.7. All Contests are void in Canada (Quebec), Brazil, Italy, and other countries and/or regions (states) where they are prohibited by national (local) law and/or require the specific permission of national (local) authorities.
1.8. A participant with a unique Support ID has the right to use only one social network account in the Contest. In each Contest, a participant can receive a gift, prize, and/or reward (hereinafter, the “Gifts”) only once. This rule also applies in cases where the Organizer holds a cross-platform Contest (e.g. on Facebook and Instagram).
1.9. Photographs, texts, videos, drawings, and other materials (hereinafter, the “Work”, “Material”) sent for a Contest must not violate moral or ethical principles and acts of law, as well as the rules, policies, and terms listed in Paragraph 1.5 of these Rules. If the Material violates these requirements, it may be removed and the entrant who sent the Material may be excluded from the Contest.
1.10. Entrants must comply with the rules, policies, terms, and instructions of the Organizer listed in Paragraph 1.5 at all stages of a Contest, as well as after the end of the Contest with regard to receiving the Gifts, transferring the rights to use the Material received from entrants to the Organizer, and complying with other requirements of the respective Contest Conditions.
1.11. The winners of the Contest may be determined either randomly or not randomly based on the Organizer’s decision according to the Contest Conditions. The Organizer has the right to use different websites and/or services to determine winners. Notwithstanding this, the Organizer shall not be liable for their performance and/or errors. The decision of the Organizer shall be final with respect to any Contest matter, including the determination of the winner.
1.12. If, according to the Contest Conditions, entrants need to use any intellectual property of the Organizer to take part in the Contest, the Organizer provides entrants with a personal, non-exclusive, non-transferable, revocable, and limited license to use the intellectual property of the Organizer strictly for non-commercial use to take part in the particular Contest. Entrants must use this license in accordance with the conditions of these Rules and the Contest Conditions and may not use the intellectual property of the Organizer for any other purpose.
1.13. The Organizer reserves the right to deny entrants the use of the Organizer’s intellectual property at any time, for any reason or without reason, including, but not limited to, if the Organizer decides, at its sole and absolute discretion, that entrants are using the Organizer’s intellectual property inappropriately. All rights reserved by MYTONA.
1.14. By sending the Material, publishing it within the official communities of the Organizer, or directing it to the Organizer in any other way, entrants hereby grant to MYTONA a royalty-free, perpetual, exclusive, irrevocable, unrestricted license to publish, distribute, reproduce, create derivative works (including, but not limited to, modifying, abbreviating and adding to, providing illustrations, preface, afterword, comments or any explanations), and to use the Material in any way for its own purposes, including on all media, whether known or to be developed in the future, on all social media platforms, and on any other media controlled or authorized by MYTONA without giving the entrant’s name, and authorize MYTONA to use names of entrants where applicable at its sole discretion in conjunction with the use of the Works worldwide and for any purpose.
1.15. By taking part in the Contest, the entrant consents to the use of their name, picture, voice, photographs, videos about them, their biographical data, as well as any statement regarding the Contest and/or a Gift made in any country, on any media, both known and to be developed in the future, on all social media platforms and on any other media controlled or authorized by MYTONA for an unlimited period of time.
1.16. The entrant gives the Organizer the exclusive right to film, photograph, dub, record, broadcast, document, and reproduce in any other way any activity related to participation in the Contest and/or receipt of any Gifts by the entrant.
1.17. Material to be submitted for participation in the Contest must be the result of personal creativity. Material that is not created by the entrant themselves, or that contains images of people or information about them without their consent, may give rise to different liabilities.
The entrant guarantees that:
1.17.1. They are the sole author and owner of the Material provided;
1.17.2. The Material does not violate any rights or legitimate interests of third parties, including, but not limited to, rights to trademarks, copyrights, related rights, and privacy;
1.17.3. The Material does not include slanderous, unlawful, hateful, or/and offensive elements. A hateful element is any element or its part that promotes or encourages discrimination, denigration, harassment, or violence based on the following protected characteristics: race, ethnicity, color, caste, national origin, immigration status, religion, sex, gender, gender identity, sexual orientation, disability, serious medical condition, and veteran status. We have a zero-tolerance policy against hateful elements;
1.17.4. No other third party has rights or grounds to claim the Material based on reasons such as a publishing or developing contract or any other contractual relationship. In the event that the status of the Material changes, the entrant agrees to immediately notify the Organizer.
1.18. The Organizer of the Contest reserves the right to select any Works at any time within the duration of the Contest and post them on any sections of the official social media pages belonging to the Organizer or any other Internet site.
1.19. The Organizer of the Contest reserves the right to choose and distribute the Gifts at their sole and absolute discretion.
1.20. Receipt of the Gifts by the winner is contingent on compliance with all relevant legislation, contracts, and regulations, as well as these Rules. The winner bears all tax, transaction and other costs/expenses. To receive the Gifts, the entrants must submit the required personal data (email, phone number, Support ID, and other information) and consent to the processing of personal data. In the case of failure to provide the required data in reasonable time (no longer than 7 (seven) calendar days), the winner loses the ability to obtain the Gifts.
1.21. No Gifts (except for monetary) can be transferred in monetary form, and no other equivalent can be provided. The awarding procedure for the Gifts is carried out by the Organizer. If, due to circumstances beyond the control of the Organizer, none of the specified Gifts can be provided, the Organizer reserves the right to award another gift equivalent to the previous one.
1.22. The Organizer reserves the right, at their sole and absolute discretion, to disqualify any entrant.
1.23. The Organizer reserves the right to demand written confirmation of acceptance of all rules and conditions of the Contest.
1.24. The Organizer does not bear liability for lost, wrongly addressed, damaged, or mistakenly provided data. In the case of incomplete and/or unlawful submission of data in a contest entry, the entrant can be disqualified. The Organizer does not bear liability in the event of technical issues, difficulties with Internet access, and/or other circumstances preventing an entrant from participating in the Contest.
1.25. The Organizer is not liable for any losses or damages resulting from or in connection with the Contest, including loss of information or transfer of computer viruses during communication, infringement of copyrights and other rights of third parties, submission of incorrect information by an entrant, and breach of these Rules, Contest Conditions, or the Organizer’s decisions regarding the Contest and/or the Gifts.
1.26. If an entrant raises a complaint or makes a claim against persons other than the Organizer concerning the Contest and/or the Gifts, such complaints and claims shall not involve the Organizer.
1.27. The Organizer bears no liability to the winner for partial or full non-fulfillment or delay in fulfilling responsibilities, if such non-fulfillment or delay are caused by force majeure circumstances outside the control of the Organizer, including, but not limited to: act of terror and/or threat of terrorism, strike, civil or military disturbance, civil unrest, blockade, embargo, acts issued by government authorities which hinder the fulfillment of responsibilities related to the Contest, accident, epidemic, fires, earthquakes, floods or other natural disasters, power failures, system or server failures, and inability to send or receive the Works, personal data, or the Gifts. The Organizer does not assume liability and does not issue compensation for additional costs if any acts or omissions of third parties caused non-fulfillment, improper or partial fulfillment of responsibilities.
1.28. Unless otherwise specified in the Contest Conditions, the Contest starts at the moment the contest post is published on the Organizer’s official social media pages. The end date of the Contest is the date stated in the Contest Conditions as the end date. If there is no end date, the Organizer reserves the right to end the Contest when it deems appropriate. If the end date is a calendar day, the Organizer chooses the exact end time of the Contest, including the time zone. The Organizer reserves the right to change the end time of the Contest at its own discretion.
1.29. In the event that contest entry dates are not specified in the Conditions, the entry period is determined by the period from the start date to (and including) the end date of the Contest.
1.30. The Organizer of the Contest reserves the right to accept Works submitted after the entry period.
1.31. The Organizer reserves the right to final and ultimate interpretation of the Rules and Contest Conditions.
1.32. The Organizer of the Contest reserves the right to specify or change these Rules unilaterally with or without appropriate notice.
1.33. In the event that the Contest Conditions do not fully or partly correspond with the Rules, priority is given to the Contest Conditions.
